Notice Board - Home Owners Associations [HOA]

Home Owners Association (HOA) in South Africa is a legal body that manages and maintains common areas and facilities within a residential community. Here’s how it works:

  1. Ownership: Individual homeowners own their properties outright, while the HOA owns and manages the common property, such as parks, pools, roads, and security entrances.
  2. Governance: The HOA is governed by a constitution or memorandum of incorporation, and it can be established as a non-profit company or a common law association.
  3. Membership: Homeowners in the community are automatically members of the HOA and must comply with its rules and regulations.
  4. Fees and Levies: Homeowners pay monthly or annual fees to the HOA to cover the costs of maintaining common areas and providing services like security, landscaping, and garbage collection.
  5. Rules and Regulations: The HOA enforces rules to maintain the community’s appearance, safety, and property values. These rules can cover aspects like landscaping, noise levels, and the use of common areas.
  6. Meetings and Elections: The HOA holds regular meetings where members can vote on important matters and elect board members who oversee the association’s operations.

HOAs help create a sense of community and ensure that shared spaces are well-maintained, benefiting all residents.
