Notice Board - Legal Marriages

 

In South Africa, there are three main types of legally recognized marriages:

 

  1. Civil Marriages: These are marriages conducted under the Marriage Act 25 of 1961, between a man and a woman. By default, they are in community of property unless an antenuptial contract specifies otherwise.
  2. Customary Marriages: These are marriages negotiated and celebrated according to indigenous African customary law. They are recognized as valid marriages and receive full legal protection.
  3. Civil Unions: These are marriages between two people, including same-sex couples, recognized under the Civil Union Act 17 of 2006. Like civil marriages, they are in community of property unless an antenuptial contract states otherwise.

Each type of marriage has its own set of rules and requirements, but all must be registered with the Department of Home Affairs to be legally recognized.
