A deceased estate in South Africa refers to the total assets and liabilities left behind by a person who has passed away. The administration of a deceased estate involves managing and distributing these assets according to the deceased’s will, or in the absence of a will, according to the laws of intestate succession.

 

Key steps in administering a deceased estate include:

  1. Reporting the Estate: The estate must be reported to the Master of the High Court within 14 days of the death.
  2. Appointment of an Executor: An executor is appointed to manage the estate. If there is a will, the executor is usually named in the will; if not, the Master appoints an executor.
  3. Inventory of Assets and Liabilities: The executor takes stock of all the deceased’s assets and liabilities.
  4. Settling Debts: The executor pays off any debts and liabilities of the estate.
  5. Distribution of Assets: The remaining assets are distributed to the beneficiaries according to the will or intestate succession laws.

 

The process ensures that the deceased’s financial affairs are settled in an orderly manner, and the interests of the heirs are protected.
